By accessing or using the services provided by Zavtra ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Zavtra provides an AI-powered virtual sales assistant and automation platform for e-commerce retailers. We utilize large language models (LLMs) and natural language processing to generate responses, analyze customer queries, and assist with support workflows on your storefront.

3. Shopify Integration & Disclaimer

If you install Zavtra via the Shopify App Store, you acknowledge that Zavtra is a third-party application. Shopify Inc. is not responsible for the functionality, content, or support of this application.Your use of Zavtra within the Shopify ecosystem is also subject to Shopify's Terms of Service and API Terms.

4. Fees, Subscriptions, and Cancellation

Depending on your installation method, fees for our services are billed either through the Shopify Billing API or directly via Stripe. All prices are listed in USD unless otherwise stated.

• Renewals: Subscriptions automatically renew based on your chosen billing interval (monthly or annually) unless canceled before the end of the current billing cycle.
• Cancellation: You may cancel your subscription at any time by uninstalling the Zavtra app from your Shopify Admin panel or via the billing settings in your Zavtra dashboard.
• Refunds: Charges processed through Shopify are subject to Shopify's billing policies. Usage-based fees (if applicable) are non-refundable.

5. Automated Output & Accuracy

Important: You acknowledge that the Services utilize probabilistic generative AI models. Output generated by the Service may occasionally be incorrect, inaccurate, or incomplete ("non-deterministic output").

• You are solely responsible for evaluating the accuracy of any output generated by our services, and you are responsible for the interactions the AI assistant has with your end-customers.
• We are not liable for any lost sales, reputational damage, or actions taken based on automated advice or content.

6. User Responsibilities

You agree not to use our services to:

• Violate any applicable laws, regulations, or third-party rights.
• Input sensitive personal health information (PHI) or financial data (PCI) into the knowledge base.
• Reverse engineer or attempt to derive the source code or underlying algorithms of our platform.

7. Intellectual Property

Your Data: You retain all rights to the data you input into Zavtra. You grant us a license to use this data solely to provide and improve the service for you.

Our Platform: Zavtra retains all rights, title, and interest in the platform, including our proprietary algorithms, interface designs, and automation workflows.

8. Disclaimer of Warranties ("As Is")

Our services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Zavtra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of your use of the application.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
